Terms of Use, Shipping & Cancellation Policy

Welcome to our online store (hereinafter: the “Website”). The Website is operated by Zemack Ltd., business ID 514437797, located at 68 Hey B-iyar St., Tel Aviv, ISRAEL (hereinafter: the “Company” and/or the “Site Management”).

Please read these Terms and Conditions carefully. Browsing, purchasing, or making any use of this Website constitutes your absolute and binding agreement to these Terms of Use.

1. General Provisions & Eligibility

• The terms apply to all users of the Website, regardless of gender. Text written in any gender applies to all genders.
• The Website serves as an e-commerce platform for the sale of original artworks, prints, and gallery merchandise (hereinafter: the “Products”).
• Purchasing on this Website is permitted to individuals who are 18 years of age or older and hold a valid credit card issued by one of the authorized credit card companies operating in Israel.
• Product images and visual previews of art on the Website are for illustration purposes only. Minor variations in color, texture, and framing may occur between the physical product and its appearance on screen due to display settings.

2. Orders & Purchase Process

• Purchasing products is completed by adding items to the shopping cart, filling out accurate billing and delivery details, and completing a secured payment.
• Providing false or misleading personal details is a criminal offense.
• The transaction is only finalized and binding upon authorization of the payment by the credit card company (or approved payment gateway) and the delivery of a detailed order confirmation email to the email address provided by the customer.
• Because some artworks or prints are unique or subject to limited editions, if a product becomes unavailable or out of stock after an order has been placed, the Company will notify the customer. The customer will be given the option to choose an alternative product or receive a full refund.

3. Shipping & Delivery Policy

• The Company will deliver the purchased products to the address provided during the checkout process within up to 21 business days from the date the transaction is approved.
• Business days do not include Fridays, Saturdays, holiday eves, holidays, and official days of rest in Israel.
• Delivery areas and their respective shipping costs are detailed during checkout. Shipments to remote areas or out of the country may be subject to longer delivery times or additional shipping fees, depending on the policy of our courier service.
• The Company is not responsible for delivery delays caused by force majeure, security events, strikes, natural disasters, or delays caused directly by the third-party shipping company.

4. Order Cancellation & Return Policy (Pursuant to Israeli Law)

Our cancellation and refund policies are strictly governed by the Israeli Consumer Protection Law, 5741-1981, and the Consumer Protection Regulations (Transaction Cancellation), 5771-2010 (hereinafter: the “Law”):

1. Cancellation Period:

• A customer may cancel an online transaction for the purchase of a product from the day the transaction is made until 14 days from the date of receipt of the product, or from the date of receipt of the transaction disclosure document (whichever is later).
• Special Populations: Customers who are persons with disabilities, senior citizens, or new immigrants (Olim Hadashim) are entitled to cancel a transaction within 4 months from the date of receipt of the product or the disclosure document, provided that the transaction involved a conversation (including email/chat) between the Company and the customer.

1. Conditions for Return:

• To be eligible for a return under a “change of mind” cancellation, the product must be returned to the Company intact, unused, undamaged, and in its original, unopened packaging.

1. Cancellation Fees & Refunds:

• Cancellation due to a defect, damage, non-conformity, or non-delivery on time: The customer will receive a 100% full refund within 14 days of the cancellation notice. The Company will be responsible for collecting the product or covering the return shipping costs.
• Cancellation due to regret/change of mind: The Company will refund the customer within 14 days, minus a cancellation fee as permitted by law, which is 5% of the product price or 100 ILS (whichever is lower). Returning the physical product safely to the Company’s gallery address (68 Hey B-iyar St., Tel Aviv) is the sole responsibility and at the expense of the customer.

1. Non-Returnable Items Under the Law:

Pursuant to the Israeli Consumer Protection Law, a transaction cannot be canceled for the following types of products:

• Goods manufactured or customized specifically for the consumer (e.g., custom-sized prints, custom-framed artworks, or commissioned pieces made to order).
• Products whose packaging has been opened and cannot be returned for health, safety, or damage risk reasons.

5. Intellectual Property

• All intellectual property, copyrights, and moral rights on this Website—including website design, computer code, trademarks, texts, images, product descriptions, and the digital files of all artworks and prints—are the exclusive property of Zemack Ltd. or the respective artists represented by the gallery.
• Purchasing an artwork or a print does not transfer any intellectual property or reproduction rights to the buyer. You may not copy, reproduce, distribute, modify, or make any commercial use of any images, artwork files, or design elements from this Website without prior written consent from the Company and the artist.

6. Limitation of Liability

• The services and products on this Website are provided on an “As-Is” basis. The user shall have no claim, demand, or suit against the Company regarding the Website’s features, limitations, or suitability for their individual needs.
• The Company (or anyone acting on its behalf) will not be held liable for any direct, indirect, or consequential damages caused to the user or any third party as a result of using the Website or purchasing products through it, beyond the monetary value of the product actually purchased.

7. Governing Law & Jurisdiction

• These Terms of Use, their interpretation, and any dispute arising from them shall be governed solely by the laws of the State of Israel.
• The competent courts in the district of Tel Aviv-Yafo, Israel, shall have exclusive jurisdiction over any legal dispute arising between the parties.
